Shipping Security Agreement

I, as identified by the details provided on the online booking site (the "Client"), hereby agree to and acknowledge the following terms and conditions related to shipping. |

Definitions: Client / you has the meaning defined above. Agreement means this Agreement. EU GDPR means the European Union General Data Protection Regulation (EU) 2016/679. We / Us means C & C Express Limited (C32212). Shipment means this shipment of goods subject to this Agreement. |

Interpretation: Headings have been inserted for the convenience of the parties to this Agreement and are not to be considered when interpreting the Agreement. A person includes a natural person, corporate or unincorporated body (whether having a separate personality or not). Unless the context requires otherwise, words in the singular include the plural, and words in the plural include the singular. Unless the context requires otherwise, a reference to one gender, includes a reference to the other genders. A reference to legislation or a legislative provision is a reference to it as amended, extended or reenacted from time to time. A reference to writing to includes fax and email. |

Accurate Declaration: All items and contents of the shipment have been accurately declared, and there are no hidden, undeclared, or misrepresented items in the shipment. |

Ownership and Responsibility: I declare that I am the legal owner or authorized representative of the owner of the shipment. I take full responsibility for the content and legality of the shipment and accept liability for any legal or financial consequences or loss that may arise directly or indirectly due to the shipment's contents. I will defend and indemnify C & C Express Limited and / or FedEx, their officers, employees and agents from and against any and all losses, damages, claims arising from the shipment. |

Security Check Authorization: I authorize the carrier, customs authorities, to conduct any necessary inspections or security checks on the shipment. I understand that the shipment may be subject to scanning, physical inspection, and clearance procedures by customs and border authorities. |

Prohibited Goods: The shipment does not contain any items listed as dangerous goods, prohibited, or restricted by air, sea, or land transport laws, including but not limited to weapons, explosives, hazardous materials, or contraband. |

Fraudulent Activity: I certify that the shipment does not involve any fraudulent or illegal activity, including but not limited to money laundering, smuggling, and/or the export of counterfeit goods. |

Notices: All notices, requests, demands or other communication will be sent to the Client by e-mail on the e-mail address provided above. |

Governing Law: This Agreement (including its construction, validity and performance), and any dispute or claim arising out of or in connection with it or its subject matter or formation (including any non-contractual disputes or claims), shall be governed by and construed in all respects exclusively in accordance with the laws of Malta. |

Jurisdiction: The Client irrevocably agrees that any claim or dispute (including any non-contractual claims or disputes) arising out of or in connection with this Agreement or its subject matter shall be subject to the exclusive jurisdiction of the Maltese courts. |

Data Protection: Definitions “Personal Data” means any information relating to an identified or identifiable natural person, including data that can be combined with other information to identify an individual. “Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. “Data Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the Processing of Personal Data; where the purposes and means of such Processing are determined by Union or Member State law, the Data Controller or the specific criteria for its nomination may be provided for by Union or Member State law. “Data Processor” means a natural or legal person, public authority, agency or other body which Processes Personal Data on behalf of the Data Controller. “Data Subject” means the individual the Personal Data relates to. “Consent” of the Data Subject means any freely given, specific, informed and unambiguous indication of the Data Subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the Processing of Personal Data relating to him or her.
The Personal Data to be Processed may include but is not limited to the information provided above. By signing this Agreement you confirm your understanding, Consent and acceptance in relation to our Processing of your Personal Data. We implement appropriate and technical organisational measures to ensure a level of security appropriate to the risk, including the prevention of unauthorised access, alteration or disclosure of Personal Data. We may engage sub-processors to assist with the Processing of Personal Data. Where sub-processors are engaged, we shall ensure that appropriate contractual arrangements are in place to ensure compliance with the EU GDPR. You confirm that you have provided accurate Personal Data, and that any changes will be communicated immediately to Us. We will retain data for the period necessary to fulfil the above-mentioned purposes unless a longer retention period is required or permitted by law. Any changes to Personal Data Processing will be communicated to you via e-mail on the e-mail address provided to us above. You have the right to access your Personal Data and to ask us to correct or update the information held or delete such Personal Data from our records if it is no longer needed for the purposes indicated above. You may exercise these rights by contacting us on verification@ccexpress.com.mt Certain Personal Data may be exempt from such access, correction or erasure requests pursuant to applicable data protection laws or other laws and regulations. If you consider that the Processing of Personal Data is not in compliance with data protection laws and regulations, you may lodge a complaint with us by writing to us by e-mail on this email address verification@ccexpress.com.mt and/or the Office of the Information and Data Protection Commissioner by following this link: https://idpc.org.mt/en/Pages/contact/complaints.aspx You have the right to data portability, and to object to the Processing of your Personal Data for the purposes of direct marketing. You also have the right to restrict the Processing of your Personal Data, should you have a valid reason at law to do so. Withdrawal of Consent: You have the right to withdraw your Consent at any time once Consent has been given. Withdrawal of Consent shall not affect the lawfulness of Processing based on Consent before its withdrawal. You may withdraw your Consent by contacting us via e-mail at verification@ccexpress.com.mt. Should You withdraw your Consent, your Personal Data will no longer be processed for the purposes outlined in this Agreement. However, some data may still be retained if required for legal compliance or legitimate interests. |

Certification and Signature: I accept and understand all of the terms of this Agreement. I also hereby certify that all the information provided in this form is true and accurate to the best of my knowledge. I understand that failure to comply with the conditions outlined above may result in delays, penalties, or seizure of the shipment.
